The verdict is NOT in

The judge heard arguments from both sides where five citizens of Overland brought a court case against the city this afternoon. She is expected to rule at a later date. However, the TRO that stated that all meetings must be held at the community center is still in effect until that ruling comes down.

New low for the mayor in hearings: Purzner argues that she doesn't have the power to move the meetings to the community center.

Why this is funny:

She has never tried to move the meetings. In fact, she threatened to fire any employee that would set up the meetings at the CC.

--AND-

When the MAJORITY of the city council requested that the meetings be moved, she refused.

Blaming the city council for not doing something she wouldn't allow to happen is courtesy of Doug Rudman. For those of you who don't remember that name, that was the attorney Purzner initially tried to appoint to Herman's position back in April.


Questions yet to be answered:

  • Will tonight and tomorrow's "special" meetings be cancelled?
  • Will there be any other “special” meetings scheduled before the August 14th regular CC meeting?
  • Will the ORT boycott the August 14 meeting?

Tonights Budget meeting did happen.

And, I think everyone in attendance was a bit surprised to see how well it seemed to go.

Both sides were talking and LISTENING to each other.

Discussions were had, compromises were made, and in the end, at least 117,500.00 will be added to the Capital Improvements budget.

I was impressed with our Council. They acted professionally. There were a few barbs and a bit of politicing, but overall it went well.

Councilman May was very active, seeking to find compromises and work out differences.

Councilman Knode, who chaired the meeting, did so fairly, and was attentive to the issues raised by everyone.

If only we could do it like this all the time.

I posted more details on the Overland Speaks Out forum, and I will be adding alot more tomarrow afternoon.

Lets hope this meeting starts a trend.

One concern on my mind though, is the idea that the budget can be changed at anytime. I realize this is necessary as we do not know what the future holds for us, but I have to wonder if this will not be a source of abuse later.

Rudman, Purzner's lawyer, spoke to several television stations after yesterday's hearings. He stated that Purzner's argument was that it is impossible to know how many people to show up, so thus, impossible to know where to schedule meetings.

In the financial world, we used a statement: "Past performance may not be inidicative of future results."

Why this statement is important in regards to Purzner?

1) Past performance of say, a mutual fund, can indicate the management strength of that fund when compared to overall market performance. Purzner's past performance may not totally say what she will do in the future. However, it is a good indicator of her future behavior.

2) How many times in the "past" do people have to be locked out of meetings until you see into the "future" that the size of the space might be an issue? It is always better to err on the side of the citizens, not over some false concern about a gym floor.

I wasn't going to post much today but i can't help but jump-in when Hot Choc and Disco Duck are being linked.

When I saw Hot Choc on American Bandstand there was no duck in sight.

Also, let us not get in the practice of referrencing Jefferson Starship and or any of its variants on this blog.

Somethings are better left forgotten.

You may be right. I think you may be giving the ORT a little too much credit. You think they could formulate such a strategy involving mutliple steps.

I only care about the substance of the budget and don't really see much reason to listen to anything the ORT says.

And as far as who was eating don't you mean your good friend Courtney who was snaking on chips at a meeting. What was she at court yesterday too.

Tell her to take a bath and put on something decent if she's going to give a citizens comment. A comb through the hair wouldn't kill her either.

Did you read Musics' last post, this is why somethings will never change.

I hope she never ends up in a nursing home old and decrepit, no family to come & see her, left all alone and it's her own fault, hopefully when the girl scouts are giving out cookies they don't pass her up.

As for the judge change, Judge Whittington is the Presiding Judge. In more cases than not, the Presiding Judge hears the immediate Temporary Restaining Order matter, then assigns the case to one of the judges on the equity docket to actually hear the Preliminary Injunction hearing (yesterday) and the eventual trial.

St. Charles - Judge dismisses suit over 'St.Chuck' web site.

In short, regarding former St. Charles city special counsel Eric Tolen.

Hayden's lawyers complained that Tolen did not make a reasonable inquiry to show that allegations in his suit were true, and said Tolen refused to respond to questions or produce necssary documents. (sound familiar)

"You can't pull stuff out of the air," said Hayden's lawyer, Dwayne Johnson

Tolen, reached by phone, said he had been so "swanped" with work that he could not file the necessay paperwork. He also said he would explore an appeal.

Also, in the post pg. B7 4 Democrats trying to unseat Akin take aim at GOP policies. Charles Karam is one of the 4.

Maybe someone out there knows more about this. I had heard for years that when he was the Public Works Dir. for Overland (1984-1999) he did not have a degree in engineering. In the article it says he earned 2 engineering degrees, one from the Univ. of Toledo & one from Wayne St. Univ. in Detroit.

What confused me was, the way I read the article, he received them in 1978 (sorry don't have the paper in front of me now). He did not become PW dir. until 1984.

I had also heard that the mayor at that time is the one who helped him get his degree (if there are any).

Had you ever heard that before?

And what I find amusing it that all these degress these people supposedly have are always from far away states. With the exception of Abby-normals one from Maryville. Karam, Owensby, Brown & the mayors other one according to her web site.

My recollection as an insider at the time of Karam's arrival is that he does in fact have a degree in Engineering but was never able to pass the certification exam to be a licensed Civil Engineer. That may have changed in the twenty years hence, but was the case at the time of his arrival.

It is also the case generally that far more people attend university at schools that are not located in Missouri. This would be the case in absolute terms as well as percentage terms. I am not saying he isn't a hack guys, don't get me wrong here.

But not everyone has the unmittigated gaul, hutspa or nerve to repeatedly lie about their academic credentials.

Only a con would do something so dishonorable, a Great Con in our case.
