Hearing update: (According to Ch 2 news at 11). Tolen is representing Ben Branch and shows up more than an hour late. At that time he requests that the judge recuse himself. The judge complied and now we are put off until this afternoon at the earliest.
I love it!
The more bullshit and stalling they try to pull on McCullogh and County, the more likely they will bury them. This isn't Law & Order or Boston Legal folks.
Judge Gaertner immediately granted the motion without arguments which tells me the Judge knows it doesn't matter which circuit the case is heard. Given they are trying to get on another docket today tells me that the hearing is going to be a mere formality.
The law and facts are clear. Also, granting motion removes any use of the "apparent" conflict as a grounds for appeal.
If Marky Mark's legal team were competant lawyers, the wouldn't be working for his Funky Bunch.

Don't worry about it. Judge Cohen is solid. The Purz-snatcher just jumped out of the frying pan and into the fire.
