Schneider: “I’m just a company man”

According to Sailor’s blog, Schneider is claiming that any and all vehicles in question were owned by his previous company, Lakewood Party Sales.

However, even if they were owned by the company in Minnesota, the vehicles should still be registered in the state of Missouri. The law is pretty clear on this (excerpted from RSMo chapter 137):

Corporate property, where taxed.
137.095. 1. ..every general or business corporation having or owning tangible personal property on the first day of January in each year, which is situated in any other county than the one in which the corporation is located, shall make return to the assessor of the county or township where the property is situated, in the same manner as other tangible personal property is required by law to be returned…shall be assessed for tax purposes in the county in which the motor vehicles are based.
2. For the purposes of subsection 1 of this section, the term "based" means the place where the vehicle is most frequently dispatched, garaged, serviced, maintained, operated or otherwise controlled, except that leased passenger vehicles shall be assessed at the residence of the driver or, if the residence of the driver is unknown, at the location of the lessee.

One would assume that these cars are primarily garaged and controlled from Overland, if Schneider was the resident he claimed to be at that time. Thus, Schneider’s company (that he fully owned and operated) was delinquent in their taxes, if not the man himself.

Schneider further told Sailor that he did everything “correctly to the best of my ability”. This doesn’t speak well for his ability and I, for one, am questioning his ability to be our mayor.

If we take this on face value that means that every company I have worked for who had fleet vehicles and operated out of one office covering multiple states with the residence of the drivers being in multiple states other than the location of said office have been in violation of the law. I'll have to make some calls tomorrow and check it out as I have a hard time believing it (I'm not suggesting you are being deceptive in any way).

as a side note, in the second section of this statute it says:

"...except that leased passenger vehicles shall be assessed at the residence of the driver or, if the residence of the driver is unknown, at the location of the lessee."

What company in their right mind would give someone a vehicle if they didn't know where they lived?

LOL

I'm still questionning what was the big hurry to run for council now mayor.

They had been gone from Overland for 20 yrs. Schneider has been heard to say "he has his own adgenda." What adgenda & is it his adgenda or what's best for Overland?

You make a valid point. I have relatives in from out of town. They were perusing both the Localite and the mailed literature. They commented how impressive MBC's literature is and how clear is her vision. They commented on the lack of substance of the other candidates.

This "agenda" thing is getting old. Purzner and the ORT have over used that word.

Mary Beth is VERY clear on what she wants to accomplish for the betterment of Overland. Her education and employment history are very impressive and applicable for turning Overland around for the better.

Keller is chanting the ORT chant of “free trash” and the ole swimming pool gig. We need to bring more revenue to Overland first, before we can even think of using city funds for “free trash” and a swimming pool. Maybe Keller and the ORT know of some tree that grows money to fund this “free trash”, because 650K is not going to cut the mustard. Unless Keller’s plan is to bankrupt Overland.
Now I know Sweetpickles is going to say “Maryland Heights has free trash”, well you are comparing an apple to an orange.

Suzyjax,

It was the use of the word "his" that didn't set well.

I have been burned in the past by people who wanted to move fast in business & personal, don't trust them.

If he needed to ask for what a 2 yr waiver in order to get his personal business taken care of I have a problem with him being able to take care of an entire city's business.

The fact he basically said nothing the entire year during Purzner's reign was another problem for me. When asked way he didn't, the comment was made "he didn't want to be part of the circus." Well, excuse me but who did. If he cared & likes Overland so much to move back here & run for council, that was not the response I was expecting. Other than those causing the circus I can't think of anyone who really enjoyed it. But they did what they had to do, he didn't.

Now he's putting us in another 3-way split again, that's another problem. Him signing up to run NOW after what this city just went through does not show me he is putting what's best for Overland above his own adgenda. Especially him not wanting to be part of a circus.

Despite where the paper trail leads, if he REALLY cares for Overland like he says he will back out on his own.

Sailor,
I guess you stopped holding your breath for an answer from Knode, in regard to the audit petition.

I told ya so...nanny nanny boo boo
just j/k ;-)

Hey onlayer-two long time no chat. Nice to see you again. :-)

I think Keller is the one that jumped in to pull the 3 way split act. Keller most likely has a lot of left over trash bags to hang on people's doors. Schneider I think had his sights on being Mayor for some time now. However, Mary Beth is the most logical candidate for Mayor.

Hi New Girl,

It's nice to be back, been busy with spring fix-ups around the house.

I blame Schneider because he signed up last, he already knew Marybeth & Keller had signed. I agree Keller has NO business running for mayor whatsoever, not only because who's backing her but because she's an idiot. Who didn't think they'd have someone running, I personally didn't think it would be her.

There is too much credit being given to the ORT. The "free trash" angle is actually a good political tatic if you really think about it. However costly it may be, in reality, we had it before, therefore, people want it back.

Onelayer..

Keller is no idiot. She is a genious, as she will personally attest to her 160 IQ.

Ladyluck,
You are right. Most folks think short-term and thus, "free trash" seems appealing. However, trash must come at some cost and those same folks when faced with reality will not be in favor of free trash over a great police department, snow removal, etc. We just need to make sure they realize these facts.

Blogger New Girl in Town said...

There are many services personally and governmentally that have been diminished or done away with over the years. We would all like them back, however if the money is not there to support these “free” programs, people have to come to that reality and make adjustments accordingly. But to snowball people into thinking that there is enough money to cover “free trash”, that is outright deceit and shameful. There are many naïve and gullible people out there, that get hoodwinked by the BS of the ORT and Keller with this “free trash” nonsense. It’s a shame they pull this crap on unsuspecting people that don’t know any better. But hey, if they get votes by BSing people, they have to live with their deceit and the underhanded way they obtained votes. Too bad they can’t get votes honorably and with integrity. But it will come back to bite them as it did, Purzner, Knode and Sellers. Owensby will find out next year. :-)

What's this I hear, Keller has a plan to bring oodles of revenue to Overland but won't say what it is? LOL The ole ORT lip service crap. Keller, try something new, the ORT has abused the ole "I have a secret plan to better Overland" routine. Can't Brown or Owenswig come up with something new for you to campaign with? Your ORT club chants are like a broken record.

This "I have a great idea to make Overland a better place to live, but I'm not going to tell" is stupid and without substance. If a person seriously has a way to turn Overland around, they would not hesitate to start implementing the idea. Keller and her supporters are talking "trash". Or is that talking smack? In any case......yaaaawnnnnnn

6:44 AM
Blogger suzyjax said...

I don't think it's trash or smack. Just, as you said, void of substance. Lacking the detail necessary to get the vote of the majority of the populace of this city.

Then again, this stuff is funny. When I read what Keller's "campaign worker" posted, I almost doubled over with laughter. (Now to clean off that coffee off my monitor from that spit-take.)

I can see Keller's next ads in the Localite. "Peggy Keller: Fruitless, yet Genius."

Suzy,
These cryptic messages from the ORT, Keller and the person that “fields Mrs. Keller’s calls” (LOL), are getting old and stale. Why can’t these people be forthright with themselves and the citizens of Overland?
Why the hide and seek games? And the answers are, lack of substance and truth.

I too had a great laugh from that comment from the secret person that “fields Mrs. Keller’s calls”. That was priceless. I wonder if that “fielder” wears a wig…..hee hee

Blogger dazzle said...

Where is that posted. The campaign worker ?
I see no reason for Keller to run no experience and shes a know it all and for sure I don't like the people supporting her as far as I saw Knodes and the one with the adams apple.Rumor is that Owensby is not helping her.
Schneider has the same problem no experience and he's arrogant and his supporters Dody Munsch and Kuhlman that scares me.
I don't like any of the candidates. A lot of people are saying they don't either some are not voting

Here's a bit of spam. I already posted this on Overland Sailor's site under
"Follow up: More Legal Trouble in Overland"

This election is far from over.
I am a bit suprised to hear that Mrs. Keller is "holding her cards" so tightly when she obviously has a Mayoral race that she wants to win.
Now would be the time to show your cards Mrs. Keller.
Afraid of someone stealing ideas? We aren't making T-shirts here. Put up or shut up.

Dazzle, that is where you can find Mrs. Keller's "phone call fielder" LOL

Ladyluck,

I thought about this more and here is Keller's reasoning:

See, she is a genius. She has bragged about her 160 IQ. Her plans, if they exist, are probably too complicated for us common folk to understand. Thus, she is waiting until the 6/25 meeting which will allow her time to "dumb down" her proposal.

*smile*

Ladyluck,
Like I said, no substance (cards close to chest when playing Fish with Grandkids maybe). Looks like you got a good laugh from the "fielder" comment too. I guess Peggy "160" Keller has an entourage now.

Dazzle,

I certainly hope people do not stay home the day of the election. I can understand where they're coming from but not voting is not going to solve anything.

8:46 AM
Blogger ladyluck said...

While the last election brought alot of people out, I have reason to think this one will have the opposite effect. Like you said Onelayer, it wouldn't accomplish anything, but as Dazzle pointed out, alot of people are questioning our choices.

Blogger onelayer said...

Ladyluck,

I agree, I know it can get very frustrating, but staying away and not voting is not the answer. I for one do not want to see Keller as mayor because others refuse to vote for who's left.

There were a lot of people who did not vote last year because they knew Purzner wouldn't get in and look what happened, we can, do not, need a repeat of last year.

OverlandChat is back online and I have to ask, since when do we not have a Health and Rabies (aka animal control) officer? We had one, let him go due to budget concerns a few years ago, hired him back as a code inspector last year if I am not mistaken, and a few months ago the Council voted to bring back the position and move him from the Code Inspectors job (which apparently he was not certified / qualified to do) back to the Health and Rabies Officer job (which apparently he is certified / qualified to do).

I assume it is possible that perhaps Overland doesn't have the proper equipment for the job at the moment, or maybe this gentleman decided to quit and move on. I did see him at City Hall at Dog Inoculation day, so I it appears he was filling that role at least until that point.

Anyone have any further information here?

Onlayer-two,
Knodes site is just an extension of the Overland Crotch Watch. I see he got rid of his "employeement" comment. I'm glad I printed it out. He is trying to be professional and says "employeement", no such word by the way. He is a joke, I don't think anybody with a quarter of a brain takes Richie Knobe seriously. Maybe he is the one that “fields” Keller’s calls. Hey Richie……did you find out the color of the garbage truck yet? Hee Hee Keller must not have much going for her if she has Knode in her corner. Eeeeeeeeeeeew

Blue Eyes that has been on the website forever and likely has not been updated yet. I would suggest calling Public Works and asking about it.

I was at the meeting where they made that decision. I choose not to post about it at the time because I didn't feel it was necessary to post about a single employee when you consider the circumstances. However, unless the gentleman quit, he was supposed to move to the health and rabies position.

I'm not sure of the city still had all the equipment (truck with cages and the like) but I am sure the move was approved. I guess only a phone call would confirm that though I will ask about it at the Budget meeting tonight assuming Chuck Boone is in attendance.

Ok,

To those on the chat, the petition against Schneider has nothing to do with an occupancy permit. He signed an affidavit stating he was not a resident of Overland until Feb. 2006. Get with the program.

4:21 PM
Blogger John Moyle said...

one/two-layer, as best as I have been able to tell there is no signed affidavit as you described. There apparently is evidence that consists of notations in the Department of Revenue computer from when a waiver was applied for (not sure if Councilperson Schneider or his wife made the application), but there is apparently no signed document to this effect concerning the waiver. I can't say if there are other documents out there that support this claim but the rumor that there is a signed affidavit stating he was not a resident until February 2006 is apparently false.

BlueEyes There are several reasons why this might have happened with FineWine. The most likely of which is that this change to bring back the Health and Rabies Officer only happened a month or so ago when the overdue budget was passed and it is entirely possible that FineWine's call was before that time.

Overland Sailor,

Not because of your response, but this is very disappointing. Because of who told me, I had absolutely no reason to doubt it or to think it was rumor.

If what was said turns out not to be true, I will have some rethinking to do.

1:41 AM
Blogger John Moyle said...

one/two layer I just want to be clear: there could be other similar evidence out there. Here on the net it has been said several times that there was a signed affidavit for personal property taxes that stated he had was not a resident until Feb 2006 and according to my information that doesn't exist.

There could be something else involved (maybe an application for title, some other DOR or State filing of some sort) that is similar in the case. I don't know, and I don't expect we will know until the case goes to court.

In other words, I am not saying there is no evidence, as I don't know, I just know that the evidence repeatedly referred to on the net recently does not appear to exist.
