Rollin' on Tolen
ALL OF THE ITEMS CONTAINED WITHIN WERE PREVIOUSLY DISCUSSED AND POSTED ON THIS BLOG IN MAY 2006!
Pardon me. But I just don't buy any excuses or explanations of any of Tolen's associates, friends, etc of the "I didn't know." (Especially since these accusations have previously been made regarding Tolen.)
Others have pointed out that Tolen was hand-picked by Brown to be the "attorney for the city council" out in St. Charles. Now, this was a bogus, made-up position where the sole purpose was to object to how the city's official attorney was advising the city.
This appointment was made but there was no way to pay him as it was not an official position. Tolen subsequently sued the city for "back pay" and at the same time said that under no circumstance could his reasons for leaving the US Attorney's office be mentioned.
Well, that raised a flag for me (why it didn't for Purzner, et al is beyond me) and I investiaged.
One of the associated charges with Tolen's dismissal was perjury in relation to a crime committed by a sibling. He was also charged with using the resources of the government in order to help with the defense of the bank robbery. He called all of these charges "minor". Hmmm...an office of the court calling perjury minor. Details are here.
It didn't take much of search to come up with the following:
Allegations of sexual misconduct
In the course of the bank robbery investigation, Fuhr interviewed Michael Buthe. (Def. App. 34, 127, 385 dep. pp. 162-63.) Buthe stated to Fuhr that Buthe met Eric Tolen at Sherwood Forest Camp when Buthe was 11 years old and Tolen was serving as a counselor. (Def. App. 34,134.) From about 1987 until 1990, Buthe lived with Tolen. (Def. App. 34, 279 dep. p. 174.) Missouri Division of Family Services ("DFS") records show that in early 1990, after Buthe complained to DFS about his situation with Tolen (including possible sexual abuse), Buthe was in the custody of juvenile authorities for several months. (Def. App. 34,127, 139-42.) Buthe returned to live with Tolen later in 1990, and continued to live with Tolen until about 1993. (Def. App. 34, 279 dep. p. 174.)On February 18, 1997, Fuhr took a videotaped statement from Buthe, in which Buthe stated: (a) that Tolen had [**21] engaged in sexual activity with him while [*14] he lived with Tolen; (b) that Buthe had found child pornography in Tolen's possession; and (c) that Buthe had recanted his report of child abuse to DFS at Tolen's urging. (Def. App. 34-35, 134-35, 386 dep. pp. 166-67.) Fuhr made the contents of Buthe's statement known to Dowd, and Dowd viewed the videotape. (Def. App. 35, 207 dep. p. 94, 389 dep. p. 177.)The FBI advised Detective Guinn of the St. Louis County Police Department of Buthe's allegations of sexual abuse by Tolen. (Def. App. 35, 386-87 dep. pp. 168-70, 402-417.) Dowd was later provided a report describing contacts that St. Louis County detectives had with several boys who associated with Tolen. Dowd concluded that the detectives believed that Tolen was sexually abusing children. (Def. App. 35, 209 dep. pp. 103-04.) On April 11, 1997, Tolen was interviewed by agents of the Office of the Inspector General for the Department of Justice. During the interview, Tolen was asked to discuss the investigation of allegations of child sexual abuse by the St. Louis County Police Department. Tolen "took the Fifth," and declined to answer. (Def. App. 35-36, 281 dep. pp. 182-83,342.) [**22]

WOW !!!! So Tolen’s pedophilia has been known about for 10 years now? The dots are starting to connect BIG TIME. Brown and McWilliams, McWilliams and Tolen, Tolen and Brown…..ORT and Tolen, ORT and McWilliams, ORT and Brown. Purzner, Sweetpickles and all of the above are “friends”? This is all turning my stomach. Seriously, I am nauseated at the fact that these people are affiliated with Overland. Child predators I feel are the sickest of criminals, even murderers and other assorted criminals can’t stand pedophiles and deal with them harshly in prisons.

I find it extremely suspect that, Sweetpickles, is trying to cover up for Purzner and her “friends” by the “how were we/she to know?” lame excuses. Pardon me, but if my “friends” made the headlines with disgusting criminal actions not too many years ago…..I would absolutely remember why. And Purzner STILL broke bread with them at the Mandarin House. Sick….no other word for it but sick. These were obviously publicized known facts before Purzner even ran for the Mayor’s office. I see FINE SWINE is trying to excuse it away too. Pathetic, sad and pathetic!!!!!

I understand that you cannot check out every person in which you do business. However, when that person makes a statement such as "if anyone brings up my past at xxx then I will sue them" that makes me want to find out what is so bad in their past that generates such a statement.

You pose a good question. Who is responsible for verifying such candidate information. In defense of the city clerk, she can only check past due records and verify that information. She can also take their statements (as required by law, under penalty of perjury) that everything is kosher. She cannot be held responsible if they make mistatements.
Due diligence is the responsibility of the press and the public. They make sure they know what is going on with the candidates. If the press or another citizen uncovers wrong doing then so be it. However, the city clerk kind of just has to take their word that they are indeed "telling the truth and the whole truth".
However, things might change...(or at least we can hope)
Fine Wine I did not accuse you of having a faulty memory, I suggested it as one of several possibile reasons why you would be saying we do not have a Health and Rabies officer when we do. I am not aware of anyone named Diana currently working at Public Works, though there is someone named Diana working in Administration. If you recall, I suggested you call Public Works.
Now I have learned that there was some confusion over this position change for several reasons. For one, apparently the people upstairs were not aware that it had gone into effect a few weeks ago. For another, while Public works is short handed this person is filling the role of the Health and Rabies officer as well as Code Enforcement.
To be clear, there is a difference between being a qualified Inspector and qualified to perform Code enforcement duties. According to Chuck Boone,at that budget workshop meeting for the 2006/2007 budget, this gentleman is not a qualified Inspector but is a qualified Health and Rabies Officer.
Sweetpickles If this person told you he was a qualified INSPECTOR you should inform him that Chuck Boone is not aware of this and he should show Mr. Boone his qualifications.
Blue Eyes You are correct, I didn't mean the way it was described. I suggested several reasons why Fine Wines could have been mistaken, only one of those reasons was that his memory could be faulty and I meant that in the way that as we age we tend to have issues with time in our heads. For example, I am sure most of us have told someone a story about an event that happened a year or two ago only to realize it was actually 10 years prior (I know I have).

As for the company kept by some declaring innocence and the like is fine, but it is also irrelevant. People regularly judge us by our the company we keep, that is simply a fact of life.
In this case we have:
Someone who had their police credentials pulled for life by the state.
Someone who shot his own front door and tried to blame a political rival.
Someone who's office was raided by the FBI for child porn.
Someone who is now in prison for bribery.
Someone who is now in trouble with the law for child molestation, who also lost his US Attorney position due to improper conduct.
And I likely missed a few.
That is what I meant by a pattern. One one side, we have people who have been the subject of still unsubstantiated rumors on the other we have people who have been the subject of indictments.
Blue Eyes If you take the Child Molestation issue off the table for the moment you still have to deal with his public and publicized dismissal from the US attorney's office. Based on the conduct that caused his dismissal I don't know why anyone would want to hire him as an attorney.
And Mr. Tolen, if you would like to sue me Over this comment go ahead. Court records are public information, if you had not filed that ridiculous suit against the US Attorney's office the information would probably not be out there (though I imagine you have bigger issues to deal with at the moment).

I see Tolen’s little side job was buying and selling computers out of his home. I guess business must be slow if he had to do that…..good grief. I wonder if he sold any computers to McWilliams? On the news last night, Tolen’s attorney said, Tolen knew this was coming. His attorney was trying to infer that these kids he allegedly sodomized were just trying to extort cash out of Tolen. Give me a break; isn’t that the same excuse Michael Jackson used?
My question is, if these kids Tolen allegedly sodomized were bothering him and trying to extort cash from him, why didn’t Tolen go to the police long ago to let them know these kids were harassing him for money and threatening him with child molestation charges if he didn’t give them money?

Personally, I think the city clerk has better things to do than verify what the candidates is telling them. She can't check everything. In addition, there is a reason the form says "under penalty of perjury".
However, I completely agree that a CA can streamline a lot of procedues at city hall and possibly incorporate a better "checks" system for future elections.

I may not know what my attorney, doctor or accountant is doing in their spare time. But I certainly know if they are a nitwit or not. Like pretending to be St. Charles' City Attorney and submitting an invoice. That would be in the nitwit category.
Psychologists have well established the fact that humans seek association with people of similar emotional I.Q.
For example, whether conscious of this dynamic or not, women abused by their fathers tend to seek abusers for husbands in adulthood. Boys abused by sexual predators become sexual predators.
What is most traumatic in adolescence becomes what is most exciting in adulthood. The trauma is hardwired into the developing brain thus child molesters are difficult, if not impossible, to
rehabilitate.

I think we will have to agree to slightly disagree on this one. Otherwise, the city clerk is more private eye than city clerk. In addition, when does it stop. How does she trust the databases she uses, the police reports, etc.? Afterall, couldn't they be misleading and/or error-riden also?
It is our responsibility as voters to know who we are voting for, not the city clerk.
That doesn't mean I don't think the CC office couldn't be run more efficiently, doesn't show favoritism/bias, etc. (which I believe is where we do agree).

I thought of a way to clarify what I am saying.
The city clerk is an appointed position. In their own job interest they might be willing to overlook or not investigate thoroughly their own bosses (mayor, city council) and be malicious to any of their bosses competition. I think to expect the cc to vet the candidates would put them in an akward position where they are subject to anyone and everyone crying foul. (Too easy to accuse bias.)
Thus, I would rather the CC accept filings, do minimal tax checks (real estate, personal property), and accept the affidavits that they are qualified to run for the position in which they are filing.
Your right, we don't agree on Brooks. Personally never met the man, the way he kept his home spoke volumes to me. Or there the lack of up-keep of said property.
There he is giving out tickets for those who don't cut their grass & he hadn't cut his for 20 yrs or more. I know the house, I saw what happened & I've seen what's been done since he left. My opinion of him has not nor will not change. He's a do as I say not what I do kind of person in my books.

I talked to one of the councilman today & was told it was $12 thousand not $16 and it has not been approved yet, they are voting on the budget from what I understand at the next meeting.
